CROSS EXAMINATION: QUICK WAY TO LEARN CROSS EXAMINATION

Cross examination is an act every lawyer must learn to do well well. It is a very important aspect of the trial process , such that it can make or destroy a party’s case. Therefore, it is important that every litigation lawyer must get him or herself abreast, acquainted and at home with the tricks, tips and techniques of cross examination.

For a quicker learning of this, it is best that the lawyer learns on the job. It is purely based on practical and not mere classroom work. Learning the act of cross examination requires focus, determination and interest. Legal practice as whole is not something someone should be forced into. It is something someone must have an unquenchable desire and flair for, before he or she can perform well.

In learning cross examination, a lawyer must endeavor to as  often as possible, witness proceedings, pay rapt attention, make note on what he or she learns every time, practice same with different scenarios, read cross examination guides, etc.

Therefore for a quick learning of the act, the following is necessary:

  1. Go to court and witness proceedings always, and pay rapt attention during cross examination
  2. Also make a note of the questions being asked and the ways they are being asked.
  3. take note of objections being raised and the ruling on those objections
  4. Read different cross examination books
  5. create fictitious scenarios and then draft a cross examination questions on that.
  6. Master the DOs and the DON’Ts
  7. More importantly, you must be interested in what you are doing. Develop focus, determination and zeal for the legal practice as a whole.
  8. Always try to find out the reason behind every question asked, how the question is couched, the reaction of the judge to the question, etc
