Cross examination is simply the questioning of a witness by a party other than the party that called him. It is aimed at discrediting the witness and rendering his testimonies unreliable. During cross examination, the lawyer tries to put some questions to the witness based on things said or contained in his evidence in chief/ testimonies.

Cross examination if well conducted, aids greatly in a party’s case. However it should be noted that the success of a cross examination is not dependent on the number of questions asked but on the relevancy and compelling nature of the questions. Too many unnecessary questions have the following negative effects

  1. it bores the judge and makes him loose interest in your cross examination.
  2. it bores the entire court
  3. it makes you lose hold of the witness you are trying to nail
  4. it gives room to the witness to make up his stories and fill up the loopholes
  5. You get yourself unnecessarily worked up as a lawyer.

During cross examination, be focused and calculative. Be conscious of when you are losing the main essence of cross examination. Stick to the target, be the master of your case, do not be antagonistic to the witness but do not also allow him to overshadow you. some witnesses can be terrible. Always have a particular thing you wish to achieve with every question you throw but never force the witness to give you the answer you tend to get.

Cross examination is a game. if you dribble well, you will win.
